20 | Overdrive | June 2019 TRUCKING CALENDAR The truck driver involved in a deadly crash on Interstate 70 near Denver in late April was charged with 40 criminal counts, including four counts of vehicular homicide. The Jefferson County district attor- ney charged Rogel Lazaro Aguilera- Mederos, 23, of Houston, in connec- tion with the April 25 crash that involved 28 vehicles, including four other tractor- trailers. Four people were killed, and four others were injured. Aguilera-Mederos was traveling east- bound driving a tractor-trailer when he lost control and crashed into traffic that was backed up from an earlier crash. He is being held in the Jefferson County Jail on a $400,000 bond. — Matt Cole PACCAR RECALLED about 5,050 model- year 2017-20 Peterbilt 520 vocational trucks because a wiring issue could result in an engine shutdown. Contact customer service at 918-259-3258 with recall number 19PBB. CALIFORNIA TRUCKER Noppol Pantiyanurak, 56, was shot and killed along eastbound Interstate 20 near Westbrook, Texas. His driving partner was wounded in the same incident, which occurred April 18. Texas Rangers arrested a suspected shooter, Brandon Christopher Madrid, 20, at the scene. MONTANA RAISED SPEED LIMITS for trucks on interstates from 65 to 70 mph and on other state highways from 60 to 65 mph. The new law also does away with day/night split speeds for trucks. At press time, the effective date had not been set. Cars still will be allowed to travel 80 mph on rural interstates and 70 mph on two-lane highways during the day and 65 mph at night. England entered into a $37.8 million class action settlement agree- ment with 17,519 drivers to end a 2011 lawsuit over its independent contractor and truck lease program. The settlement terms await final approval by a federal court. A July 9 hearing is scheduled in Salt Lake City federal district court after the settlement received preliminary approval last January. Class members are drivers who had lease agreements with Opportunity Leasing dba Horizon Truck Sales and Leasing, as well as an independent contractor operating agreement with C.R. England between May 27, 2007 and Jan. 31, 2017. The refrigerated hauler stated some drivers were unhappy "with their experience, and we hope that this settlement resolves any lingering concerns." Plaintiff attorney C.J. Krawczyk said the average plaintiff award will be $1,000. They also will be eligible for "relief from collection of disputed outstanding debts for truck opera- tions and driving school tuition, and an opportunity for credit and DAC reporting repair." The settlement does not include acknowledgement of wrongdoing or liability from either party. The plain- tiffs alleged that C.R. England vio- lated Utah's Truth in Advertising Act, Business Opportunity Disclosure Act and Consumer Sales Practices Act. The agreement includes requests that $68,500 go to plaintiffs Kenneth McKay and the Estate of Charles Roberts, the original plaintiffs in the case. Finally, it seeks nearly $16.3 million in attorney fees and litigation costs. — Jill Dunn C.R.
